Terms of Service

Last updated: April 1, 2026

Please read these Terms of Service ("Terms") carefully before using OpenGPC ("Service", "we", "us", or "our"). By submitting an application or using our website, you agree to be bound by these Terms.

1. Description of Service

OpenGPC is a monetization partnership service for Google Play Console developers. We partner with developers ("Partners") to publish fully-compliant commercial applications on their behalf, managing all associated responsibilities under the Google Developer Distribution Agreement (DDA).

2. Eligibility

To use our service, you must:

  • Be at least 18 years of age.
  • Own or have lawful control of an active Google Play Console developer account.
  • Have the legal authority to enter into binding agreements.
  • Not be located in a country subject to embargoes or trade restrictions.

3. Partnership Agreement

Upon acceptance of your application, you will receive a separate Partnership Agreement that governs the specific terms of our working relationship, including payout amounts, timelines, and responsibilities. These Terms of Service supplement, and do not replace, that Partnership Agreement.

4. Your Responsibilities

As a Partner, you agree to:

  • Provide accurate and truthful information in your application.
  • Publish only the application file we provide to you, without modification.
  • Maintain your Google Play Console account in good standing.
  • Promptly notify us of any communications from Google regarding your account or published applications.
  • Not engage in any activity that violates Google's Developer Program Policies.

5. Our Responsibilities

OpenGPC agrees to:

  • Conduct a full compliance review of each application before delivery.
  • Ensure applications meet all applicable Google Play policies at the time of publishing.
  • Handle all user support, reviews management, and app maintenance.
  • Pay agreed-upon compensation within 48 hours of successful app publication.
  • Indemnify you against claims arising from the content of applications we provide, subject to the conditions in your Partnership Agreement.

6. Prohibited Conduct

You may not:

  • Provide false information in your application or account details.
  • Modify, reverse-engineer, or tamper with any application file we provide.
  • Publish additional applications on the same account without our prior written consent.
  • Attempt to misrepresent your account's age, standing, or history.

7. Payment & Compensation

All compensation is detailed in your individual Partnership Agreement. Payments are made via the method agreed upon in writing. OpenGPC reserves the right to withhold payment if it is determined that you have violated these Terms or your Partnership Agreement.

8. Intellectual Property

All applications provided by OpenGPC remain the intellectual property of OpenGPC or its licensors. You are granted a limited, non-exclusive, non-transferable license to publish the application solely on your Google Play Console account as agreed.

9. Limitation of Liability

To the maximum extent permitted by applicable law, OpenGPC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid to you in the three months preceding the event giving rise to liability.

10. Indemnification

You agree to indemnify and hold harmless OpenGPC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your breach of these Terms, your misrepresentation of account information, or your unauthorized modification of provided applications.

11. Termination

Either party may terminate the partnership with 14 days' written notice. OpenGPC may terminate immediately if you breach these Terms, violate your Partnership Agreement, or engage in conduct that jeopardizes our business or reputation.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify active Partners of material changes by email. Continued use of the service after changes constitutes acceptance of the new Terms.
